General terms and conditions
Please read these carefully. They are as brief and to the point as I can make them, but please ensure that you fully understand their scope:
1.Client confidentiality will be rigorously respected at all times
2.Work cannot begin until a purchase order number has been received
3.Work will be invoiced as soon as it has been signed off or, where the job spreads over an extended period, monthly on an interim basis
4.Creative consultancy work will be invoiced on completion of each project, or monthly, where a retainer agreement is in place
5.Any booking cancelled within 24 working hours of the scheduled start time will be charged at 100% of the agreed fee or day rate
6.Any booking cancelled within 48-24 working hours of the scheduled start time will be charged at 50% of the agreed fee or day rate
7.If work is delayed for more than 30 days or cancelled at any time after a project has begun, I will invoice in full for all work completed to that date
8.If the brief alters materially during the course of the job, the right is reserved to re-estimate cost
9.Copyright ownership of all work remains with Nick Berry until full payment has been received and cleared
10.Settlement terms are 30 days
11.Full payment is deemed to grant the client copyright ownership of the work in perpetuity, unless otherwise agreed in writing
12.Payment can be made by BACS or direct bank transfer (you will be responsible for any bank charges), standing order or business cheque drawn in GBP
13.If your bank returns your cheque or refuses a bank transfer or standing order, you will be held responsible for all bank charges and any other costs
14.In the case of persistent or unreasonable late payment, I will enforce my statutory rights under the Late Payment of Commercial Debts (Interest) Act 1998 or EU Directive 2000/35/EC, as appropriate
15.Any commission supported by an order number is deemed to indicate acceptance of these terms.
Specific terms and conditions for copy editing services
1.These terms and conditions are in addition to those listed above, all of which apply to all work undertaken by Nick Berry
2.Settlement terms for copy editing work are 14 days from receipt of invoice; this will be specified on your invoice and I ask that you respect those terms
3.In the unlikely event that you are not satisfied with my editing work and can demonstrate why, you will receive a full refund of any payment received in respect of the relevant text
4.Any commission, whether verbal or written in any form, is deemed to indicate acceptance of these terms.
